When investing in real estate, you need a good title partner. Our job is to make sure that the title to a piece of real estate is free and clear of all liens and encumbrances and that ownership is with the proper individual or entity. Once we have reviewed and cleared title, we are able to issue a title insurance policy for that property.
The value of title insurance and our process
Title insurance protects the lender and/or owner against outside claims of ownership, liens or encumbrances against the property. One of the most important real estate documents is the deed which puts the world on notice to who the record title holder of the property is. Many documents from closing are put into official county records, which is known as recording. This is an important part of the process and provides a traceable chain of title to a property to establish ownership and lien priority.
The title search matters
When title is searched we review the ownership and the legal description of the property. In the search we check the legal description, making sure there are no liens or encumbrances, and verify the individual or entity who actually owns the real estate involved in your transaction.
- A legal description of property is a way to define or accurately pinpoint where a particular piece of property is located. A street address also identifies a physical location but not in the same way that a legal description defines it and, in fact, they sometimes do not even match. Some legal descriptions are very simple and involve a lot and a block within a subdivision name. Even those can be wrong when verified by surveying equipment.
- Another type of legal description is metes and bounds. This involves using the public surveying system. It uses townships and ranges. The legal description pinpoints the location of the subject property within its particular Township, Range and Section, which might also involve degrees and distance.
- Types of Encumbrances can include items such as: Easements, Encroachments, Lease, Lien, Mortgage, and Restrictive Covenants. These can prevent property owners from exercising full control over their property, and in severe circumstance could allow for property to be repossessed by a creditor or by the government.
